What are my options for divorce in Illinois?
Because every situation is different, there are different options open to you. Some are more involved (and can cost more) while others are relatively simple (and cost less). Take a look at the options below to see which best fits your needs.
Contested Divorce
Contested divorce (divorce involving litigation) occurs when the parties cannot agree on important matters like division of assets, custody, or child support or maintenance (alimony) payments.
However, contested divorce also offers tools to protect your family in situations of abuse, substance abuse, and other situations that can make communication or negotiations difficult.
This option does cost more – but it also involves a lot more. At Diamond Legal, we’ve seen it all – we will always look for ways to save you money, but we’ll also be up front about what you need.
Retainers for simple contested divorces may start as low as $4,500 but may be more depending on the complexity of the issues being disputed. The average full cost of a divorce in Illinois is around $15,000 to $20,000. The cost can be more or less than that depending on a number of factors.
Uncontested Divorce
Uncontested divorce is an option for spouses who agree on everything (or almost everything) for their divorce. This includes things like division of assets, custody and parental responsibilities, parenting schedules, child support, and maintenance or alimony.
It is technically possible to handle your uncontested divorce yourself, but we don’t recommend it. Even when you agree, divorce is still a very complicated process, and having the advice of an experienced attorney can save you a lot of time and money down the road.
Uncontested divorce is a simpler and faster process, and because no litigation is usually needed, we offer a flat rate service that may be as low as $4,500.
Limited Scope
Some clients aren’t ready for full representation yet, either because they’re early on in their case or because of financial restraints.
We completely understand, and we want everyone to have access to the legal help they need.
This is why we offer Limited Scope. This program allows you access to an experienced family law attorney – so when you have questions, you can bring them to someone who will give you the answers you need.
Many of our Limited Scope clients later choose to move to either an uncontested divorce flat fee service or a full representation retainer, and this can be done quickly and easily. Our Limited scope services may be able to start with a retainer as low as $1,500.
