You might be wondering if you’ll have to pay alimony, or whether you’re eligible to receive it. If the court determines that you either owe or are eligible to receive alimony, it will calculate the terms and amount.

In Illinois, the process for calculating alimony (also called maintenance) is based on a variety of elements, including:

  • Age and condition of the spouse who earns less
  • Earning ability of the lesser-earning spouse
  • Earning capacity of both spouses
  • Length of the marriage
  • Whether there is a history of domestic abuse

There are also different types of alimony that may apply, depending on your situation. It could be temporary (just during the divorce proceedings), short term (until the spouse is able to finish a degree, find a better job, etc.)

If permanent alimony is granted, there is no specific end date for payments. In many cases, it will be granted until a) one of the two spouses dies or b) the recipient remarries or cohabitates with another person on a conjugal basis.
